What are the foreign work permit assessment criteria?
What are the evaluation criteria for applicant workplaces and foreigners regarding the work permit request determined in accordance with Article 13 of the Implementing Regulation of the Law on Work Permits of Foreigner No. 4817?

Employment of at least Five Turkish Citizens

It is compulsory to employ at least five Turkish citizens in the workplace requesting work permit. If a work permit is requested for more than one foreigner in the same workplace, the employment of five Turkish citizens is sought separately for each foreigner after the first foreigner who obtained work permit.

In case the foreigner requesting permission is a partner of the company, the employment requirement of five persons shall be sought for the last six months of the one-year work permit given by the Ministry.

Paid Capital

The full paid capital stock of the workplace must be at least 100,000 TL, gross sales must be at least 800,000 TL or the final export amount must be at least USD 250,000.

Criteria of Foreign Company Partner

The paid capital of the company partner should not be less than 150.000 TL.

In case the foreigner requesting permission is a partner of the company, the employment requirement of five persons shall be sought for the last six months of the one-year work permit given by the Ministry.

Work Permit Criteria for Household Services

In the evaluation of work permit applications of foreigners who will work in household services, the paid capital and at least five TC citizens requirements are not compulsory.

Foreigners Exempted from Foreign Work Permit Criteria

  • Foreigners whose mother, father or child are Turkish citizens

  • Foreigners who have been married with a Turkish citizen for at least three years

  • Turkish Republic of Northern Cyprus Citizens

  • Foreigners who have been obtained a residence permit in the context of Turkish and related communities

  • Foreigners who have been obtained a residence permits within the framework of humanitarian considerations

  • Foreigners who have been obtained a residence permit as a victim of human trafficking

  • Foreigners who have been obtained a residence permit in the status of stateless

Criteria that must be met by Foreigners:
  • If the work permit application is to be made in Turkey, the foreigner must have a six-month residence permit.

  • Work permit is issued for the duration of the passport.

  • If the work permit application is to be made from abroad, the residence permit requirement is not needed.
